The ordinance requires data centers meeting certain size or electricity-demand thresholds to obtain a conditional use permit from the county. Developers must also provide information about expected electricity demand, water use and emergency-response plans as part of the permitting process. Hyde argued that the ordinance could expose the county to unnecessary legal and financial risks. A separate transparency ordinance also approved, requiring the county’s Planning and Development Department to notify all justices of the peace when site plan applications are filed and identifying which justice of the court districts would affect each application.
